Triumphs in Consumer Justice- Our Three Remarkable Victories !!

It is with immense pride that CVC wishes to state that had taken up 3 genuine consumer complaints and took it the matter with the District Consumer Disputes redressal Commission and have obtained favorable judgments in all 3 cases!  It was a team effort from the core members of CVC, over the last 6 to 8 months and without engaging any lawyers, we directly pursued the cases legally with the respective DCDRC.
Case 1: Ms. S. Achsha-vs-  Fashnear Technologies Pvt Ltd., (MEESHO Online Shopping)
Brief detail of the Complaint: The Complainant processed payment for 14 sarees the MEESHO platform and she received only one saree and they were not willing to return the balance funds or send the balance sarees.
Brief details of the Order Judgement, issued by DCDRC: In the result, this complaint is partly allowed directing the opposite party i) to pay the complainant Rs.3,276 (which represents the difference between the purchase price of the product and the amount refunded by the opposite party) ii) to pay a sum of Rs.10,000/- (Rupees Ten thousand only) as compensation for mental agony suffered by the complainant due to deficiency in service and iii) to pay a sum of Rs.5000/- (Rupees Five thousand only) towards cost of the proceedings. The above amounts to be paid to the complainant within a period of one month from the date of this order failing which the opposite party shall be liable to pay interest at the rate of 9% p.a. towards the above said total amount till it is realized.
Case 2: K. Muralidharan -vs- Professional Couriers Pvt Ltd.,
Brief detail of the Complaint: M/s Professional Couriers accepted to deliver a parcel containing inner wear for a super citizen residing in Hyderabad, after accepting the agreed courier charges. However, on reaching the destination station they asked the Consignee to come over to their office and collect the parcel or agree to pay an additional fee for door delivery, which is against the very purpose of dispatching goods by courier, especially to a super senior citizen.
Brief details of the Order Judgement, issued by DCDRC: This complaint is partly allowed. The opposite parties No.1 to 3 are directed jointly and severally to pay the complainant (i). a sum of Rs.5,000/- (Rupees five thousand only) towards compensation for deficiency in service, (ii). a sum of Rs.2,000/- (Rupees two thousand only) towards compensation for mental agony caused to the complainant and (iii) a sum of Rs.3,000/-(Rupees three thousand only) towards cost of this complaint within two months from the date of receipt of this Order, failing which the compensation amounts shall carry interest at the rate of 9% p.a. from the date of this Order, till realization.
Case 3: N. Karuppusamy -vs- RVS Senthil Andavar Thirumana Mandapam
Brief details of the Complaint: The Complainant had paid an advance of Rs. 70,000 to the Opposite party for booking the mandapam to conduct the marriage of his daughter during the Covid pandemic. In view of the lockdown and strict rules laid down by the Govt. the marriage had to be postponed. The complainant approached the Opposite party seeking refund of the Rs. 70,000 paid as advance. Although the Govt. had issued necessary Orders to refund such amounts to consumers, the Opposite party confirmed to pay only Rs. 60,000 stating administrative charges.
Brief details of Order Judgement, issued by DCDRC: This complaint is partly allowed. The Opposite Party is directed to (i). refund a sum of Rs.70,000/-(Rupees seventy thousand only) to the complainant towards refund of booking charges, (ii). to pay a sum of Rs.30,000/-(Rupees thirty thousand only) towards compensation for deficiency in service, (iii). to pay a sum of Rs.25,000/- (Rupees twenty five thousand only) towards compensation for unfair trade practice, (iv).to pay a sum of Rs.25,000/-,(Rupees twenty five thousand only) towards compensation for mental agony caused to the complainant and (iv).to pay a sum of Rs.10,000/-(Rupees ten thousand only) towards cost of this complaint, within two months from the date of receipt of this Order, failing which the refund amount and the compensation amounts shall carry interest at the rate of 9% per annum from the date of filing of this complaint, that is, from 24.04.2023 to till realization.

Successfully took up against usage of ‘air horns’ in commercial vehicles and rules are now in place to penalize offenders

Bank

During demonetisation – raised many issues, with RBI in order to ease the enormous difficulties raised by the public

DSO

Senior citizens who had difficulties in affixing fingerprints, at PDS outlets, are now exempted from this requirement, due to efforts taken by CVC

Aavin

CVC mooted the idea to increase the number of licensed vendors to operate ‘booths’ and high-end parlors in the city

Corporation Authorities

Transparency in procedure for building plan approvals, thru’ computerization. Status check on Water connection applications, thru’ computerization.  Road repairs and
non-conformity of fly over bridge design was taken up

District Road safety

Repeated campaigns were conducted in schools, along with Traffic Police teams, to educate kids about traffic rules and the importance to its adherence.  Along with RTO officials’ campaigns were successfully conducted to stop ‘minors’ from riding two / four wheelers

Electricity Services Provider

After prolonged follow up, TANGEDCO have introduced Serial numbering system on all poles in the city for ease of tracking location and its maintenance.

Current Areas of Interest

Colleges are where the change in outlook must find formal substance. CVC is in the process of signing Memorandums of Understanding with premier colleges in & around Coimbatore, to form Consumer Clubs in their respective campus to get the attention of student community, who will be the driving force for a better tomorrow. Currently it has tied up with over 15 colleges, who will soon be a part of the CVC Family.

CVC plans to conduct inter-collegiate ‘mock court’ competitions, related to CPA, soon which will be followed by ‘slogan / essay writing’ on climate control & waste management

A unique Certificate Course on Consumer Protection, Waste Management & its impact on Environment and basics of RTI has been launched, in association with NGM College Pollachi on 1st Oct 2022. The enrollment was capped to 50 students and faculty includes eminent Consumer Activists, Environmentalists and distinguished Professors from Colleges.

CVC has successfully introduced ‘Field Water Testing Kits’ thru’ college students and various other help groups to help citizens / farmers check the quality of water, on site to ‘indicate’ if the water is suitable for the intended application. The forum intends to come up with similar test kits for other products like milk, fossil fuels, vegetable oils etc

To undertake a series of ‘guest lectures’ at various UG / PG level colleges, in association with their respective Placement Cell, to show case the window of opportunities that lay in the field of ‘Waste Management’ and the abundant potential available in becoming entrepreneurs

Constant follow up related to re-introduction of trains between Coimbatore and Rameswaram, via Pollachi and Tirunelveli. To pursue our efforts in obtaining railway concessional fares for senior citizens, which was stopped during the Covid pandemic period

To keep reminding authorities, about the urgent need to improve the ‘storm water drainage’ system in Coimbatore, especially at major under bridge road intersections

Repetitive messages and constant follow up to eradicate the foul smell emanating from the Vellolore dump yard (land fill) and to get the Micro Composting Centers operational for better waste management
